Class Counsel will file your exclusion request with the Court. The Court will exclude you from the Class if you send a proper request before the deadline. If you fail to do so, you will automatically become a member of the Class.
You cannot exclude yourself by telephone or email. You cannot exclude yourself by mailing a request to any other locations on or after the deadline. You must sign the Opt-Out Form. You cannot exclude yourself by having an actual or purported agent or attorney acting on behalf of you or a group of Class Members sign the letter.
REQUESTS FOR EXCLUSION THAT ARE NOT POSTMARKED ON OR BEFORE JUNE 25, 2025, WILL NOT BE HONORED.
If you already have your own lawsuit against RCC and want to continue with it or want to start your own lawsuit against RCC based upon claims that are similar to those in the class action, you need to ask to be excluded from the Class. If you exclude yourself from the Class – sometimes called “opting-out” of the Class – you will not receive any money or benefits from this lawsuit even if the Plaintiff obtains them as a result of the trial or from any settlement (that may or may not be reached) between RCC and the Plaintiff. However, you may then be able to sue or continue to sue RCC directly. Note that, if you do not exclude yourself from the Class, you will be bound by any judgment issued by the Court or settlement approved by the Court, even if you don’t agree with it.
If you do nothing, you will automatically be included in the Class. You will stay in this lawsuit and shall await the outcome but give up your legal rights. You will have the possibility of getting money or benefits that may be awarded as part of a trial or settlement. However, you will give up and waive any rights to sue RCC separately based on the same legal claims. If you stay in the Class, you will be required to provide documents and/or testify at a deposition and/or at trial. If you stay in the Class and the Plaintiffs obtain money, either as a result of a trial or a settlement, you will be notified, and you may be entitled to monetary compensation. If you remain in the Class, you will be bound by any order the Court issues, judgments made by the Court or jury verdict in this case, including judgment in RCC’s favor, ad settlements approved by the Court, even if you don’t agree with it, and you will not be able to sue RCC separately for the same legal claims or issues in this case. If you do not exclude yourself, you will be legally bound by all orders that Court issues and judgments the Court makes in this Class action.
If you want to be excluded from the Class, you must request exclusion by June 30, 2025. If you exclude yourself, you will not receive any money or benefits from this lawsuit even if the Plaintiffs obtain them as a result of this class action, or from any settlement (that may or may not be reached) between the Plaintiff and the RCC. However, if you chose to exclude yourself from this lawsuit, you will preserve your rights to sue RCC separately based on the same legal claims.
